USER TERMS AND CONDITIONS (“Terms”)

1. General

1.1 Please read these terms and conditions (the “Terms”) carefully before downloading and using the LogoLogoQuiz app or the LogoLogoQuiz website (the app and website together being referred to in these Terms as “LogoLogoQuiz”). Your use of LogoLogoQuiz constitutes your acknowledgment and agreement to these Terms and to our Privacy Policy. If you do not accept these terms, do not use LogoLogoQuiz.

1.2 LogoLogoQuiz is intended to for your own personal, recreational use only and may not be used for commercial or any other purposes

1.3 The Company makes no representation that LogoLogoQuiz is available or appropriate in all locations.

2. Your use of LogoLogoQuiz

2.1 We do not sell, trade or rent your Personal Information to third parties.

2.2 By submitting or sending any other information to us you warrant that it is original to you and that no other party has rights over such information and you thereby transfer ownership to such information to the Company and that accordingly, the Company shall have the right to use, adapt, publish, translate, create derivative works from, distribute, perform and display such information and/or incorporate it in other works of any form, and you waive any rights to such information. You agree that any such information that you provide to us will not be treated as confidential or proprietary.

2.3 You are responsible for any information or material that you provide via the Website, email, or though a social media network. You agree not to upload, post or otherwise transmit content that:
(a) is harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, or otherwise objectionable to the Company or other users of LogoLogoQuiz;
(b) includes unauthorized disclosure of another’s personal information;
(c) violates or infringes another’s intellectual property rights; or
(d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. Any information or material that you upload, post or otherwise transmit via the Website in breach of these terms may be removed by the Company.

2.4 You may not use LogoLogoQuiz:
(a) to transmit spam, bulk or unsolicited communications;
(b) to damage, disable, overload or impair the operation of LogoLogoQuiz or its use by third parties;
(c) to pretend to be someone else, use someone else’s identity in any way, or misrepresent your affiliation with a person or entity;
(d) in a way that would violate any applicable law, including attempting to compromise the security of LogoLogoQuiz or by collecting personal data about other users without permission;
(e) to rent, lease, loan, sell, distribute, mirror, frame, republish, download, store, transmit, or create derivative works from LogoLogoQuiz, in whole or in part, by any means; or
(f) to modify, decompile, or reverse engineer any software used in LogoLogoQuiz. You must not use, remove or modify any copyright, trademark, or other proprietary notices belonging to the Company (“Notices”) for any reason.

2.5 Your access to and use of LogoLogoQuiz may be monitored and the Company may terminate your access to it at any time at its discretion, with or without cause.

3. Ownership of the content of LogoLogoQuiz (the “Content”)

3.1 LogoLogoQuiz is owned by the Company and it maintains copyright protection and other intellectual property rights in the Content. You acknowledge that no right, title or interest in any Content or Notices are transferred to you under these Terms. The Content may not be reproduced in whole or in part without the prior written consent of the Company.

3.2 You agree not to incorporate any of the Notices into your trademarks, service marks, company names, internet addresses, domain names, or other similar designations. You may not remove or alter any Notices or co-brand your own products or materials with Notices without the Company’s prior written consent. You acknowledge the Company’s rights in its Notices and agree that any use by you of any such Notices shall inure for the sole benefit of the Company.

4. Privacy

4.1 You agree that the Company may access, keep, use and disclose your Personal Information if and as required to:

a) comply with legal requirements;
b) deal with your requests for service;
c) enforce these Terms;
d) respond to claims by third parties that you have breached any third party rights;
e) protect the rights, property and safety of LogoLogoQuiz, its users and the public; or
f) report activity or exchange information with other organizations for the purposes of fraud protection and credit risk reduction in circumstances where the Company believes that LogoLogoQuiz is being used for the commission of a crime.

5. Advertising and links to other sites 5.1 There may be links to other internet sites on the Website. The Company is not responsible for the availability of such external sites and does not endorse and is not responsible for any content, products, services or other materials available from such sites. The Company is not liable, directly or indirectly, for any loss or damage caused by or in connection with any such site.

5.2 The Website may contain advertising created by third parties. We do not control, endorse or approve the content of any such advertisements, and we do not review or approve any products or services which are advertised on the Website. You acknowledge and agree that we are not responsible for the legality, accuracy, or appropriateness of any advertising, or of the products, services, or information so advertised which is located on the Website or on any other websites, or for any loss or damages caused or alleged to have been caused by the use of, or reliance on, any such advertising content.

5.3 While the Company may occasionally make endorsements or recommendations, we do not recommend products or services that appear as pop-up advertisements, and our endorsements are limited to those products and services, if any, that we explicitly recommend.

6. Disclaimers

6.1 YOUR USE OF LOGOLOGOQUIZ IS AT YOUR SOLE RISK. THE CONTENT IS PROVIDED ON AN "AS IS" BASIS. THE COMPANY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, OR NON- INFRINGEMENT. THE COMPANY GIVES NO WARRANTIES AS TO THE SUITABILITY, ACCURACY OR COMPLETENESS OF LOGOLOGOQUIZ.

6.2 THE COMPANY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS GIVE NO WARRANTY THAT: (a) LOGOLOGOQUIZ WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR- FREE; (b) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF LOGOLOGOQUIZ WILL BE ACCURATE OR RELIABLE; (c) LOGOLOGOQUIZ OR ANY CONTENT OBTAINED THROUGH THE WEBSITE OR OTHERWISE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS; OR (d) ANY ERRORS IN LOGOLOGOQUIZ WILL BE CORRECTED.

6.3 YOU ASSUME ALL RISK FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM USING LOGOLOGOQUIZ, INCLUDING ANY DAMAGE RESULTING FROM COMPUTER VIRUSES.

7. Limitation of liability

(a) TO THE FULL EXTENT PERMITTED BY LAW, THE COMPANY AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES (INCLUDING FOR LOSS OF BUSINESS, REVENUE, GOODWILL, USE OR DATA) ARISING OUT OF OR IN CONNECTION WITH LOGOLOGOQUIZ, OR ANY SITE LINKED TO THE WEBSITE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, HOWEVER THEY ARISE, WHETHER IN BREACH OF CONTRACT, IN TORT (INCLUDING NEGLIGENCE), OR OTHERWISE.

7.2 TO THE EXTENT THAT ANY JURISDICTION DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, PORTIONS OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

8. Indemnity

8.1 You agree to indemnify and hold the Company and its subsidiaries, affiliates, officers, employees, agents, partners and licensors harmless from any claims, costs, liabilities, demands, and expenses, including reasonable attorneys' fees, made by any third party due to, or arising out of: (i) your use of LogoLogoQuiz; or (ii) any inaccurate personal or other information provided by you (intentionally or otherwise) in using LogoLogoQuiz.

9. Miscellaneous

9.1 If the Company does not exercise or enforce any particular right or provision in these Terms, it does not waive that right or provision. If a court finds any provision of these Terms invalid, then you agree that the court should try to follow the intention of that provision and that all other provisions of these Terms will remain in effect.

9.2 The Company may change these Terms at any time by posting the amended Terms on the Website. All terms are effective as soon as they are posted and remain in effect until they are superseded by new Terms. The Company may assign or delegate these Terms and/or the Privacy Policy in whole or in part, to any person or entity at any time, with or without your consent. You may not assign or delegate any rights or obligations under these Terms or under the Privacy Policy without the Company’s prior written consent, and any unauthorized assignment or delegation by you is void and ineffective.

9.3 The laws of the State of Israel govern these Terms. You agree that the courts of Tel Aviv have exclusive jurisdiction to hear and determine any claim or dispute between you and the Company (and its members, managers, officers, employees, agents and assigns) which directly or indirectly relate to these Terms or to any matter arising from your use of LogoLogoQuiz.
